Breakthrough therapy and accelerated approval: the menin field took the fast review and declined the shortcut

also called BTD · breakthrough therapy designation · accelerated approval · subpart H · FDORA 2022 · RTOR

Breakthrough therapy designation buys a drug company close, frequent attention from FDA during development; accelerated approval lets a drug be sold on a lab measure that is only expected to predict benefit, with a follow-up trial owed afterwards. Both menin inhibitors for leukaemia took the fast review, but neither was approved on the accelerated pathway - they were approved outright, which is a better outcome than the field usually gets.

The same thing, for a scientist

Breakthrough therapy designation (FDCA 506(a), created by FDASIA 2012 section 902) requires a serious or life-threatening condition plus preliminary clinical evidence of substantial improvement over available therapy on a clinically significant endpoint; it buys intensive FDA engagement, senior organisational commitment and rolling review, and explicitly does not lower the evidentiary standard for approval. Accelerated approval (FDCA 506(c); 21 CFR part 314 subpart H) permits approval on a surrogate or intermediate endpoint reasonably likely to predict clinical benefit, conditioned on a confirmatory trial. Section 3210 of FDORA 2022 gave FDA four new levers: it may require the confirmatory study to be underway before approval, it has a streamlined withdrawal procedure, sponsors must report confirmatory trial status publicly, and an internal Accelerated Approval Council was created. Revumenib holds breakthrough therapy designation for relapsed or refractory KMT2A-rearranged acute leukaemia and was reviewed under priority review, fast track and Real-Time Oncology Review, but the approved label carries no accelerated approval statement and the approval letter imposes no efficacy confirmatory trial - it is a regular approval. Ziftomenib likewise received full approval. The sharp finding sits elsewhere in the same approval letter: FDA waived the paediatric study requirement for patients under 1 year old as impossible or highly impracticable.

Go deeper
Breakthrough therapy designation: what it changes and what it does not

Criteria (FDCA 506(a), created by FDASIA 2012 section 902) 1: the drug is intended to treat a serious or life-threatening condition, and preliminary clinical evidence indicates it may demonstrate substantial improvement on a clinically significant endpoint over available therapies. "Preliminary clinical evidence" means human data - so unlike orphan designation, BTD cannot be obtained on mechanism alone.

What it buys 1: all fast track features; intensive FDA guidance on efficient development starting as early as phase 1; organisational commitment involving senior FDA managers; a cross-disciplinary project lead; frequent meetings; eligibility for rolling review and priority review.

What it does not change: FDA is explicit that "regulatory standards to demonstrate safety and efficacy must still be met" 1. BTD is a process instrument. It compresses calendar time and improves the quality of sponsor-agency dialogue; it does not lower the bar.

Used here? Yes. FDA granted revumenib breakthrough therapy designation in December 2022 for adult and paediatric patients with relapsed or refractory KMT2A-rearranged (MLLr) acute leukaemia, following fast track designation in June 2021; the eventual NDA also received priority review and was handled under Real-Time Oncology Review 4. Ziftomenib's sponsors state it received breakthrough therapy, fast track and priority review as well.

Accelerated approval: the shortcut and the debt it creates

The pathway (FDCA 506(c); 21 CFR part 314 subpart H for drugs, part 601 subpart E for biologics) 2. FDA may approve a product for a serious condition that fills an unmet medical need on the basis of a surrogate endpoint - "a marker, such as a laboratory measurement, radiographic image, physical sign or other measure that is thought to predict clinical benefit but is not itself a measure of clinical benefit" - or an intermediate clinical endpoint. In oncology the classic surrogate is overall response rate, or CR+CRh in acute leukaemia.

The obligation. The sponsor owes a confirmatory trial to verify clinical benefit. The label must state that continued approval may be contingent on that verification.

What FDORA 2022 changed. Section 3210 of the Food and Drug Omnibus Reform Act of 2022 (enacted in the Consolidated Appropriations Act, 2023) amended FDCA 506(c) to give FDA four things it previously lacked 3:

  1. Authority to require the confirmatory study be underway before approval. The Secretary "may require, as appropriate, a study or studies to be underway prior to approval, or within a specified time period after the date of approval." This is the single most consequential change; a trial that has not enrolled its first patient at approval historically often never finished.
  2. A streamlined withdrawal procedure where the sponsor fails to conduct a required postapproval study with due diligence, or the study fails to verify benefit.
  3. Mandatory public reporting of confirmatory trial status.
  4. An Accelerated Approval Council inside FDA, with published annual activity reports.

Why the debt matters empirically. Of 129 cancer drug-indication pairs granted accelerated approval 2013-2023, among the 46 with more than five years of follow-up, 63% converted to regular approval, 22% were withdrawn and 15% were still pending after a median 6.3 years - and fewer than half (20 of 46, 43%) demonstrated clinical benefit in confirmatory trials 10. A separate cohort of 102 converted indications found a median 3.1 years to conversion, and confirmed that initiating the confirmatory trial before approval was associated with faster conversion 11 - which is precisely the behaviour FDORA now lets FDA compel.

Was accelerated approval used for KMT2A? No - and this is worth stating plainly

Secondary coverage of the revumenib approval sometimes describes it as accelerated. It was not. Three primary-source checks:

  1. The approved label. The full prescribing information for REVUFORJ (NDA 218944, approval 2024-11-15) was read in full. The indication reads, without qualification: "REVUFORJ is indicated for the treatment of relapsed or refractory acute leukemia with a lysine methyltransferase 2A gene (KMT2A) translocation in adult and pediatric patients 1 year and older." The strings "accelerated approval" and "continued approval" do not appear anywhere in the document 5. An accelerated approval label is required to carry that statement.
  2. The approval letter. FDA's approval letter for NDA 218944 contains no subpart H language. Its postmarketing requirements (4730-1 through 4730-6) are imposed under FDCA 505(o)(3) and are about safety and pharmacokinetics - sudden death, QTc prolongation, differentiation syndrome, transaminase elevation, parathyroid hormone, hepatic and renal impairment dosing, OATP1B1 interaction. There is no efficacy confirmatory trial requirement 6.
  3. The second indication. FDA's announcement of the 2025-10-24 NPM1-mutant approval records priority review and fast track and does not use the term accelerated approval 7. Ziftomenib (Komzifti, 2025-11-13) is likewise reported as a full approval 12.

So the menin-inhibitor field, as of 2026-09-18, has taken every acceleration of review on offer - fast track, breakthrough, priority review, Real-Time Oncology Review - while accepting conventional evidentiary standards at approval. Given the JAMA data above, that is a genuinely good outcome and the field should get credit for it. It also means the classic accelerated-approval failure mode - a paediatric confirmatory trial that never finishes - is not the live risk here. A different one is.

The live risk: infants were waived out, in writing

The Pediatric Research Equity Act (21 U.S.C. 355c) requires a paediatric assessment with every application for a new active ingredient, unless waived, deferred or inapplicable. FDA's approval letter for revumenib says this, verbatim 6:

"We are waiving the pediatric study requirement for patients less than 1 year of age because necessary studies are impossible or highly impracticable. This is because of the small number and geographical dispersion of pediatric patients in this age group."

Read that against the disease. KMT2A rearrangement is the defining lesion of infant acute lymphoblastic leukaemia; the under-1 population is not an edge case of the KMT2A indication, it is the population in which KMT2A-rearranged leukaemia is most characteristic and most lethal. The first approved drug for KMT2A-rearranged acute leukaemia carries a statutory paediatric study waiver for exactly that group, on feasibility grounds, and the approved label states that safety and efficacy under 1 year "have not been established."

To be fair to the programme, the registrational cohort was genuinely paediatric-inclusive by the standards of adult oncology: 104 patients, median age 37 years (range 1-79), 24% under 17, including 13 infants under 2 years, 41 children aged 2 to under 12 and 16 adolescents 9. That is not a token. The waiver bites below 1 year, not below 18.

The contrast with the NPM1 arm is where the age problem is real. Ziftomenib's pivotal KOMET-001 cohort (n=112) had a median age of 69 years, range 22-86, with 63% aged 65 or older and no patients under 18 8. Revumenib's NPM1 cohort was similarly older. A commonly repeated claim that "the approved menin trials had a median age of 66-69" is true of the NPM1 studies and false of the KMT2A study; this node records the correction because getting it backwards inverts the policy argument.

How this could bite us back
  • The bluntest distortion in this file is not accelerated approval - it is the PREA waiver. FDA's own approval letter waives the paediatric study requirement for patients under 1 year old as 'impossible or highly impracticable' because of 'the small number and geographical dispersion' of those patients. KMT2A rearrangement is the defining lesion of infant leukaemia. The regulatory system granted the first KMT2A drug an exemption from studying the population the lesion most characterises, and gave as its reason the very rarity and dispersion that the orphan and paediatric incentive programmes exist to overcome. The incentives and the obligations are pointed in opposite directions.
  • Breakthrough therapy designation is granted on the strength of early data in a hard-to-treat population, but nothing ties the designation to that population persisting in the registrational programme. A sponsor can earn BTD on a paediatric-inclusive KMT2A signal and then expand into the far larger adult NPM1 market, where accrual is faster and the commercial return is an order of magnitude larger. Revumenib's second indication arrived eleven months after its first, in a cohort where roughly half the patients were over 65. The designation pulled the programme forward; the market decided where forward pointed.
  • Accelerated approval on CR+CRh would have been available here and was not taken - but the counterfactual is instructive. Approving on a 21.2% CR+CRh rate with a confirmatory trial owed later would have created exactly the standing risk the JAMA data document: fewer than half of accelerated oncology approvals with five years of follow-up ever demonstrated clinical benefit, and 21% of confirmatory trials had not even started at approval. In a disease where the paediatric cohort accrues at a handful of patients per year worldwide, a confirmatory trial that is not underway at approval is a trial that may never read out. The field avoided this. The pathway still permits it.
  • FDORA gave FDA the power to require a confirmatory trial be underway, but it is discretionary ('may require, as appropriate'). Discretion applied to a sponsor with a large adult indication and a small paediatric one predictably lands on the adult side, where accrual makes the requirement cheap to satisfy. The statute does not distinguish a confirmatory trial that is feasible from one that is not, and it is the infeasible ones that need compelling.
  • The expedited withdrawal procedure has a paediatric asymmetry nobody discusses. Withdrawing an accelerated approval removes access for everyone in the indication. In an adult indication with alternatives that is a defensible correction; in relapsed infant KMT2A-rearranged leukaemia, where the alternative is salvage chemotherapy and transplant, withdrawal is not a neutral act. The streamlined procedure increases the chance that a drug children depend on is removed on the strength of an adult-dominated confirmatory trial that failed for adult-specific reasons.
  • A widely repeated claim - that the approved menin trials had a median age of 66 to 69 - is true of the NPM1 studies and false of the KMT2A study, whose median age was 37 with 24% of patients under 17 and 13 infants enrolled. Repeating the wrong number makes the paediatric case look worse than it is and, worse, aims the criticism at the one trial that got the age distribution closest to right. Distorted incentives deserve accurate accounting too.
Still open
  1. Was the 2025-10-24 NPM1 supplement to NDA 218944 a regular approval? FDA's announcement does not say 'accelerated', but the sNDA approval letter was not retrievable at the expected Drugs@FDA path and the supplemental labelling was not read.
  2. Is the Komzifti label free of accelerated-approval language? This node relies on trade press for that, which is the weakest link in it.
  3. On what evidence did FDA conclude that studies in patients under 1 year of age are 'impossible or highly impracticable' for a disease whose paradigm population is infants, and what would change that determination - an international consortium trial design, a registry-based commitment, an extrapolation framework?
  4. Now that FDA may require confirmatory trials to be underway before accelerated approval, has any paediatric oncology accelerated approval actually been conditioned that way since 2023?

FDA's accelerated approval programme allows earlier approval of drugs for serious conditions that fill an unmet medical need on the basis of a surrogate endpoint thought to predict clinical benefit but not itself a measure of clinical benefit, with sponsors still required to conduct studies confirming the anticipated clinical benefit.

Evidence that argues against this (1)
    • An absence observed through a public search interface on one date bounds what that interface returns, not what exists. Regulatory documents are published on lags that differ by agency and by document type, a 404 can reflect a URL scheme change, and designations under several of these programmes are explicitly not publicly disclosable — so the absence is partly structural. A press announcement is also a summary written for a general audience and omits designations routinely; absence from it is weak evidence about the regulatory record.
